Terms of Service

    Plain English: HomeLaxy is a software tool, not a real estate broker, agent, attorney or escrow company. We help you search, list and organize a direct transaction. The deal itself is between you and the other party. Property data is informational and may be wrong, so verify everything, and consider hiring a licensed attorney or title company.
  

1. Acceptance of these terms

These Terms are between you and HomeLaxy Real Estate LLC ("HomeLaxy," "we," "us"). By accessing or using homelaxy.com or any HomeLaxy service (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old and able to form a binding contract.

2. What HomeLaxy is, and is not

HomeLaxy provides online tools that let you (a) search for homes and property information, (b) list your own home for sale after identity verification, and (c) where available, request tours and prepare offers. HomeLaxy is not a licensed real estate broker, brokerage or agent, does not represent any buyer or seller, does not negotiate on anyone's behalf, and does not provide legal, tax, financial, appraisal or inspection advice. We are not a party to any transaction between users.

Buying or selling without an agent is legal, but real estate transactions are regulated and vary by state. You are responsible for understanding and complying with the laws that apply to your transaction, including disclosure, contract, financing and closing requirements. We encourage you to consult a licensed attorney, title company or other professional.

3. Property data and estimates

Property information, photos, prices and estimated values shown in search results come from third-party sources (currently RealtyAPI, which aggregates listing data such as Realtor.com) and may be incomplete, out of date or inaccurate. Estimates are not appraisals. Listing status and prices can change at any time. Verify all details independently before making any decision or offer.

4. Beta service

HomeLaxy is currently in beta. Features may change, be limited or be removed without notice. Some tools, including tours and offer preparation, may be unavailable or limited to certain states. The Service may be interrupted, contain errors, or lose or reset data, and we make no uptime or availability commitment. Do not rely on the Service as your only record of anything important, and keep your own copies of listing information and any documents.

5. Identity verification

To publish a listing, request a tour or submit an offer, you must complete identity verification through our provider, Stripe Identity. Verification includes a government ID and a selfie, and Stripe creates a scan of your face geometry to match them. We ask for your express consent before verification starts, and our Privacy Policy explains how this works. You agree to provide accurate information and only your own identity documents. Verification confirms that a person matched their ID. It is not a background check and is not an endorsement, guarantee or assessment of any user's character, ownership of a property, financial ability or intentions. Verification can fail or be reversed, and we may refuse or revoke access at our discretion.

6. Listings you submit

You may list only a property you own or are legally authorized to sell. By submitting a listing you:

represent that all information, photos and descriptions are accurate, lawful and not misleading, and that you have the right to publish them;
grant HomeLaxy a non-exclusive, worldwide, royalty-free license to host, display, reproduce and distribute your listing content in connection with operating and promoting the Service;
agree not to post anything that is unlawful, fraudulent, discriminatory (including in violation of the federal Fair Housing Act or any state or local fair housing law), infringing, or that you do not have the right to share; and
understand that a live listing, including its address, price, description and photo, is publicly visible.

We may review, decline, suspend, edit or remove any listing at any time, with or without notice, and we do not guarantee that any listing will be published, viewed, or result in a sale.

7. Transactions between users

Any tour, offer, contract, payment or closing is solely between the buyer and seller (and any professionals they choose). HomeLaxy does not hold funds, provide escrow, prepare binding contracts for your specific situation, or guarantee that any party will perform. Contract templates and offer tools are made available only in states where we have completed our own review, may change or be withdrawn, and are not a substitute for advice from your own attorney. You are solely responsible for any agreement you sign.

8. Acceptable use

You agree not to: use the Service for any unlawful purpose; impersonate anyone or submit false identity information; scrape, copy or bulk-download data from the Service or attempt to circumvent rate limits or other protections; probe, disrupt or attempt unauthorized access to the Service or other users' data; or use the Service to harass, defraud or discriminate against anyone. We may suspend or terminate access for violations.

9. Intellectual property

The Service, including its design, text, graphics, software and the HomeLaxy name and logo, is owned by HomeLaxy or its licensors and protected by law. Subject to these Terms, you may use the Service for its intended personal purposes. Third-party property data and marks belong to their respective owners.

10. Third-party services and links

The Service relies on and may link to third parties (including Stripe, Cloudflare, Vercel, RealtyAPI and Realtor.com). We do not control them and are not responsible for their content, availability, accuracy or practices. Your use of them is subject to their own terms.

11. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that any property data, estimate, listing or user is accurate, reliable or trustworthy, or that any transaction will close or produce any particular savings.

12. Limitation of liability

To the fullest extent permitted by law, HomeLaxy and its owners, affiliates, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data or goodwill, or for any loss arising from a transaction between users, from reliance on property data or estimates, or from the acts or omissions of any user or third party. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid HomeLaxy in the 12 months before the claim or one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify and hold harmless HomeLaxy and its owners, affiliates, officers, employees and contractors from claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your content or listings, your use of the Service, your transactions, or your violation of these Terms or any law or third-party right.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access or remove your content at any time for any reason, including suspected violation of these Terms. Sections that by their nature should survive termination will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Wisconsin, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

16. Changes to the Service and these Terms

We may change, suspend or discontinue any part of the Service, and may update these Terms. We will post the updated Terms here with a new "Last updated" date. Continued use after changes take effect means you accept them.

17. General

These Terms and the Privacy Policy are the entire agreement between you and HomeLaxy about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
